White Lives Matter Trademark – Lesson in IP and Free Speech

In September 2022, musician and entrepreneur Ye (formerly known as Kanye West) wore a shirt that contained the term WHITE LIVES MATTER at a fashion show for Yeezy, his former collaboration with Adidas.

In response to this, in October 2022, radio host Jae Gibson (known as Ramses Ja) submitted a trademark application for the term to use in association with clothes. Eventually, the owner on the trademark application became an LLC.

After researching the trademark history of this application, I decided to speak with my trademark colleague Ana Juneja about it. During our talk, we discussed the potential reasons the application may ultimately fail, how the media incorrectly stated that the trademark had an owner, and free speech.
